My child was born in China — what nationality? · Yalla China
🤝 Governing law: 中华人民共和国国籍法 / Nationality Law
Does China grant nationality just for being born there?
Illustrative, general educational examples — not real specific facts and not legal advice; for awareness only. For an actual situation, consult a licensed lawyer.
Situation: A foreign couple had a baby in China and assumed the child became Chinese by birth. Rule: China follows 'right of blood', not 'right of soil': a child is Chinese if a parent is Chinese; a child of two foreign parents born on Chinese soil does not acquire Chinese nationality. China also does not recognise dual nationality: a child of a Chinese-and-foreign couple born abroad who gains another nationality at birth may not be treated as Chinese. Lesson: register your newborn at your consulate and obtain the right visa/residence for them.
🎓 The lesson / takeaway
China grants nationality by descent, not birthplace, and rejects dual nationality.
